Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Honkpost LLC, a Florida limited liability company (“Honkpost”, “we”, “us”), covering https://honkpost.com, its apps, its API and its Model Context Protocol (MCP) server (together, the “Service”).

You must be at least 18, or the age of majority where you live, to use the Service. If you use it on behalf of a business, you accept these Terms for that business and confirm you have the authority to do so.

Honkpost lets you write, schedule and publish posts to third-party social networks you connect, and lets AI applications you authorize do the same on your behalf. Features, supported networks and limits may change at any time.

• Give accurate sign-up details and keep them current. We may require you to confirm your email before you can post.
• You are responsible for everything done through your account, including actions taken by AI applications, API keys and connected tools you authorize.
• Keep your password and API keys secret. Tell us immediately at support@honkpost.com if you suspect unauthorized access.
• One person or business per account. Do not share, sell or transfer accounts.

You own the content you schedule or publish through the Service and are solely responsible for it. You grant Honkpost a limited, worldwide licence to store, process and transmit that content only as needed to run the Service, including sending it to the networks you choose.

You confirm you have every right needed to publish your content, and that publishing it does not violate any law or anyone else's rights.

You may not use the Service to:

• Send spam, run coordinated inauthentic activity, or evade any platform's rate limits or enforcement.
• Publish unlawful content, or content that is hateful, harassing, defamatory, sexually exploitative or violent.
• Infringe copyright, trademark or other intellectual property rights.
• Distribute malware or attempt to access accounts, systems or data that are not yours.
• Reverse-engineer, overload, scrape or interfere with the Service.
• Resell or offer the Service to others without our written permission.

We may remove content, block posts or suspend accounts that we believe break these rules, without notice.

The Service includes AI features (writing help, an in-app agent and image generation) and accepts instructions from AI applications you connect. AI output can be inaccurate or inappropriate. You are responsible for reviewing what is published from your account, and for any labelling or disclosure a platform or law requires. We are not liable for content generated or sent by AI.

• Trial. New accounts get a 7-day free trial. It needs a card. When it ends, it becomes the plan you picked and we charge for it then, unless you cancel before the trial ends. Without an active paid plan, posting stops; your account and data remain.
• Billing. Paid plans are billed in advance, monthly or yearly, and renew automatically until cancelled. Payments are processed by Stripe. Prices exclude taxes, which you pay where applicable.
• Cancellation. Cancel any time in Billing. Your plan stays active until the end of the paid period and is not renewed.
• Refunds. The 7-day free trial is how you try Honkpost, so payments are non-refundable, including partly used periods and image credit packs. If we charge you by mistake (twice, or after you cancelled), email support@honkpost.com and we will refund that charge.
• Failed payments. If a payment fails or is disputed, we may pause posting until it is resolved.
• Price changes. We will give at least 14 days' notice by email before a price change applies to your next renewal.

Publishing depends on networks such as Instagram, Facebook, TikTok, LinkedIn, YouTube and X, which we do not control. You must follow each platform's terms and policies. A platform may change its API, reject a post, limit your reach or suspend your account; we are not responsible for those decisions. Honkpost is not affiliated with or endorsed by any of these platforms.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that any post will be published at a particular time or at all.

To the maximum extent permitted by law, Honkpost is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill, followers or account access, arising from your use of or inability to use the Service.

Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the three (3) months before the claim arose, or fifty US dollars (US$50).

You will defend and indemnify Honkpost against any claims, losses and costs (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms or any platform's rules.

You can stop using the Service at any time and ask us to delete your account (see the Privacy Policy). We may suspend or terminate your access at any time if you breach these Terms, create risk or legal exposure for us, or if required by law. Sections that by their nature should survive termination (including 4, 9, 10, 11 and 14) survive.

We may update these Terms. Material changes will be announced by email or in the app before they take effect. Continuing to use the Service after that means you accept the updated Terms.

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
